What is a commercial dispute?

Disputes from trade and business dealings, such as supply, service, franchise or partnership agreements, of a specified value of ₹3 lakh or more under the Commercial Courts Act.

Is mediation required before filing a commercial suit?

Yes. Pre-institution mediation under Section 12A is mandatory unless the suit seeks urgent interim relief.

Can I go to court if my contract has an arbitration clause?

The dispute generally goes to arbitration. Courts can still grant interim protection under Section 9 and appoint an arbitrator under Section 11.

What can a small business do about delayed payments?

MSMEs registered under the MSMED Act, 2006 can approach the MSME Facilitation Council for payment with interest.
