Matters We Handle

Frequently Asked Questions

How long do I have to file a money recovery suit?

For most money claims, the limitation period under the Limitation Act, 1963 is 3 years, counted from when the right to sue arises.

What is a summary suit?

A faster procedure under Order XXXVII CPC for claims based on written contracts, bills of exchange or cheques. The defendant must get leave of the court to defend.

Can I stop someone from acting until the case is decided?

Yes. Courts can grant a temporary injunction during the suit if there is a prima facie case, and if the balance of convenience and the risk of irreparable harm favour it.

What happens after I win a civil case?

If the other side does not comply, the decree is enforced through execution proceedings.
